These Terms of Service ("Terms") form a binding agreement between you and Build Better Habit ("we", "us", "our"), the provider of the Build Better Habit habit-tracking application and website (the "Service"). By creating an account or continuing to use the Service, you agree to these Terms.
You must be of legal age in your jurisdiction (or have the authority to bind the organization you represent) to use the Service. You are responsible for keeping your account credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it up to date.
You must not misuse the Service. In particular, you agree not to:
Subject to these Terms and your selected plan, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal habit-tracking purposes.
We retain all right, title and interest in and to the Service, including the software, documentation, design, and Build Better Habit branding. You retain ownership of the content you submit (habits, journal entries, notes); you grant us a limited licence to host and process that content solely to operate and improve the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, applicable taxes, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled; cancelling stops future renewals and your paid access continues through the end of the current billing period.
Refund requests are handled by Paddle in accordance with our Refund Policy.
We work to keep the Service reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. Features may change, be added, or be removed as the product evolves.
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination your right to use the Service ends; you may request an export of your data within a reasonable period before deletion.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Build Better Habit is a productivity tool and is not a substitute for medical, mental-health, or professional advice.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or personal injury caused by negligence).
You agree to indemnify and hold Build Better Habit harmless from any claims arising from content you submit, your unlawful use of the Service, or your violation of these Terms.
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email. Continued use of the Service after the changes take effect constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which Build Better Habit is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where local consumer-protection law grants you the right to bring proceedings in your country of residence.
